By booking or participating in a charter with Infinity Getaway Charters, you agree to the following Terms & Conditions. These policies are intended to promote a safe, enjoyable, and reliable experience for all guests.
The Charter Agreement Controls
At the time of booking, guests will be asked to sign the Infinity Getaway Charters Charter Agreement, which contains the complete terms governing the charter. In the event of any conflict between these website Terms & Conditions and the signed Charter Agreement, the Charter Agreement controls.
Reservations and Payment
Reservations are subject to availability and are confirmed once the required booking information and payment have been completed.
Infinity Getaway Charters uses FareHarbor to facilitate certain online reservations and payments. FareHarbor operates as a booking and payment service. Your charter is provided by Infinity Getaway Charters, and these Terms & Conditions govern your participation in the charter.
Passenger Capacity
Infinity Getaway Charters accommodates a maximum of six passengers per charter, including infants. This limit may not be exceeded.
If a party arrives with more than six passengers, additional guests will not be permitted to board. No refund will be issued because a party arrives with more passengers than the vessel is permitted to carry.
Cancellations and Refunds
Cancellations made at least four weeks before the scheduled charter are eligible for a refund of the charter price, less the non-refundable FareHarbor booking fee.
Cancellations made within four weeks of the scheduled charter are non-refundable.
A 6% FareHarbor booking fee applies to online bookings and is non-refundable, including when a charter-price refund is otherwise due.
Weather Cancellations
The captain has final authority in determining whether weather, water, sea, or other operating conditions are safe for the charter.
If Infinity Getaway Charters cancels a charter because conditions are determined to be unsafe, guests will be offered the opportunity to reschedule. If a mutually acceptable alternate date cannot be arranged, the charter price will be refunded. The FareHarbor booking fee remains non-refundable.
Guests should not assume that a charter has been canceled based on weather conditions at their hotel, residence, or another location. Unless notified otherwise by Infinity Getaway Charters, guests should plan to arrive as scheduled.
Company Cancellations
Infinity Getaway Charters reserves the right to cancel a charter when necessary because of mechanical issues, vessel availability, captain availability, safety concerns, weather, or other circumstances affecting the ability to safely provide the charter.
If Infinity Getaway Charters cancels the charter and an alternate date cannot be arranged, the charter price will be refunded. The FareHarbor booking fee remains non-refundable.
Late Arrivals
Guests are responsible for arriving at the designated meeting location at the scheduled time.
Late arrivals may result in a shortened charter because Infinity Getaway Charters cannot delay later reservations. The scheduled ending time will generally remain unchanged when guests arrive late.
Refunds or partial refunds are not provided for charter time lost because of a guest's late arrival.
Captain's Authority
The captain has final authority over the vessel and all activities taking place aboard or around it.
Guests are required to follow the captain's instructions regarding navigation, boarding, swimming, water entry, alcohol consumption, passenger behavior, weather, marine traffic, and other matters affecting safety.
The captain may change the route, destination, itinerary, or activities when reasonably necessary because of weather, water conditions, marine traffic, safety concerns, or other circumstances.
Water Entry and Swimming
Jumping, diving, swimming, floating, or otherwise entering the water is permitted only with the captain's approval. Guests must follow all instructions regarding when, where, and how they may enter or exit the water.
Illegal Drugs
Infinity Getaway Charters maintains a zero-tolerance policy for illegal drugs and prohibited substances aboard the vessel.
The possession or use of medical marijuana on or around the vessel is strictly prohibited, regardless of its legal status under state law.
Possession or use of illegal substances may result in immediate termination of the charter without refund. The captain may also refuse boarding when illegal substances are discovered before departure.
Smoking
Smoking, vaping, and the use of e-cigarettes are not permitted aboard the vessel. Guests who smoke while dockside must properly dispose of cigarette butts and other smoking materials.
Alcohol and Guest Conduct
Guests who consume alcohol are expected to do so responsibly. Infinity Getaway Charters strongly recommends the use of rideshare services such as Uber or Lyft, a taxi, or a designated driver for groups planning to consume alcohol.
The captain may refuse boarding, restrict alcohol consumption, or terminate a charter when a guest appears excessively intoxicated or when a guest's conduct creates a safety risk for the vessel, captain, passengers, or others.
A charter terminated because of unsafe, threatening, illegal, or seriously disruptive guest behavior may be ended without refund.
Weapons
The possession of weapons of any kind aboard the vessel is strictly prohibited. The captain may refuse boarding or immediately terminate a charter without refund if a weapon is discovered aboard or in the possession of any guest.
Pets
Pets and other animals are not permitted aboard the vessel at any time.
Safety and Assumption of Risk
Recreational boating and activities on or near the water involve inherent risks. These may include vessel movement, waves, wakes, changing weather, slippery surfaces, swimming hazards, marine life, other vessels, docks, boarding and disembarking, and changing water conditions.
By participating in a charter, guests acknowledge the ordinary and inherent risks associated with recreational boating and water activities. Guests are responsible for following all reasonable safety instructions provided by the captain.
Nothing in these Terms & Conditions is intended to waive any right or responsibility that cannot lawfully be waived.
Guest Responsibility for Vessel Damage
Guests are responsible for any damage to the vessel, its equipment, or its furnishings caused by their own negligence, misuse, or intentional acts, or by the negligence, misuse, or intentional acts of anyone in their party.
Guests are also responsible for extraordinary cleaning costs that result from conditions beyond normal charter use, including but not limited to spills or food dropped on the deck or fabrics, the use of spray sunscreen or oils that stain the vessel, sickness caused by excessive alcohol consumption, or the introduction of prohibited substances aboard the vessel.
Photo and Media Release
Infinity Getaway Charters may take photographs or video during charters for use on our website, social media accounts, marketing materials, and other promotional purposes.
By participating in a charter, guests grant Infinity Getaway Charters permission to use their likeness in photographs and video taken during the charter for these purposes, without additional compensation.
Guests who prefer not to be photographed or included in video should notify the captain at the beginning of the charter, and reasonable efforts will be made to accommodate the request.
Personal Belongings
Guests are responsible for their own personal property, including phones, cameras, sunglasses, bags, clothing, jewelry, and other belongings brought aboard.
Infinity Getaway Charters is not responsible for personal property that is lost, misplaced, damaged, or dropped into the water, except to the extent required by applicable law.
Itinerary and Destinations
Specific destinations, routes, wildlife sightings, water conditions, or experiences cannot be guaranteed.
The captain may alter the itinerary when conditions make another destination or route safer or more appropriate. Such changes do not, by themselves, constitute grounds for a refund.
FareHarbor
Infinity Getaway Charters uses FareHarbor for certain booking and payment services. Customers using FareHarbor may also be subject to FareHarbor's separate Terms of Service and privacy policies.
Customers booking a charter through FareHarbor enter into a direct contractual relationship with Infinity Getaway Charters. FareHarbor is not a party to the charter contract itself.
FareHarbor booking fees are non-refundable, regardless of the reason for cancellation, and are governed by FareHarbor's own terms. Guests who book directly by phone with Captain Daryl avoid the FareHarbor booking fee entirely.
FareHarbor is responsible for its own platform, booking fees, payment facilitation, and related services under its own terms. Infinity Getaway Charters remains responsible for providing the charter itself.
Governing Law and Venue
These Terms & Conditions are governed by the laws of the State of Florida, without regard to its conflict of law principles.
Any disputes arising from these Terms & Conditions or from any charter shall be resolved in the state or federal courts located in Okaloosa County, Florida.
Changes to These Terms
Infinity Getaway Charters may update these Terms & Conditions periodically. The version in effect at the time of booking will generally apply to that reservation unless otherwise required by law.
